These SMS Terms govern text and multimedia messages sent through any OhTry, Inc. ("OhTry") product or service, delivered through our carrier partner Twilio. They cover messages OhTry sends in its own name — sales follow-up, account and security notifications, and OhTry Mobile alerts — as well as messaging capabilities OhTry provides to its customers through OhTry Mobile, our government solutions (311, permitting, licensing, public records, and utility billing), ohtry.ai applications, and custom enterprise applications we build and host. Section 9 describes how these terms apply when OhTry provisions numbers and Twilio subaccounts to a customer that sends messages under its own brand. By providing your mobile number and checking the consent box on an OhTry form, you agree to these terms.
1. Program Description and Consent (Opt-In)
Program name: OhTry Customer & Account Messaging.
How you opt in: You provide your mobile number on the OhTry contact form, quote request form, or account settings page and check the box that reads: "I agree to receive SMS text messages from OhTry at the phone number provided. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. See our SMS Terms and Privacy Policy." The checkbox is never pre-checked, and consent to receive text messages is never a condition of purchase or of using any OhTry service.
Consent may also be captured verbally during onboarding or in a signed order form, in which case OhTry records the date, time, and method of consent.
2. Types of Messages You May Receive
- Customer care / conversational: replies from our sales or support team about an inquiry or quote you submitted.
- Account notifications: security alerts, one-time verification codes, service status, and billing reminders.
- Product notifications: OhTry Mobile voicemail summaries, missed-call alerts, and message notifications you enable.
- Government and constituent notifications: for agencies using our 311, permitting, licensing, public records, and utility billing solutions — service request status, appointment and inspection reminders, permit and license updates, and billing or outage notices sent to residents who requested them.
- Business application notifications: alerts, workflow updates, and appointment reminders sent from custom enterprise applications and ohtry.ai-built applications that OhTry hosts.
OhTry does not send unsolicited marketing, affiliate marketing, or third-party promotional messages, and does not send messages relating to loans, cannabis, gambling, or other prohibited content categories.
3. Sample Messages
"OhTry: Thanks for contacting us. A solutions engineer will follow up about your project today. Reply STOP to opt out, HELP for help."
"OhTry: Your verification code is 481920. It expires in 10 minutes. Reply STOP to opt out, HELP for help."
"OhTry Mobile: You have a new voicemail from (555) 010-2233. Summary: requesting a callback about permit #4471. Reply STOP to opt out."
4. Message Frequency
Message frequency varies based on your account activity and the notifications you enable. Most recipients receive fewer than 10 messages per month. Conversational replies occur only when you contact us.
5. Cost
OhTry does not charge for text messages. Message and data rates may apply from your mobile carrier. Carriers are not liable for delayed or undelivered messages.
6. Opt-Out (STOP) and Help (HELP)
To stop messages, reply STOP to any message from OhTry. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT. You will receive a single confirmation message and no further messages, except that replying START or UNSTOP will re-subscribe you.

7. Supported Carriers
Messaging is supported on major U.S. carriers, including AT&T, Verizon Wireless, T-Mobile, US Cellular, and many regional carriers. Carriers are not liable for delayed or undelivered messages.
8. Privacy of Mobile Information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subprocessors that support the messaging program — such as Twilio, which transmits the messages on our behalf — is limited to what is necessary to deliver the service, and those providers may not use the information for their own marketing. Text messaging originator opt-in data and consent are not shared with any third party for marketing purposes.

9. Platform Customers, Provisioned Numbers, and Subaccounts
OhTry operates as a software platform and independent software vendor (ISV) reseller of communications services built on Twilio. In addition to messages OhTry sends in its own name, OhTry provisions phone numbers, short codes, toll-free numbers, and isolated Twilio subaccounts to its customers ("Platform Customers") so they can send and receive messages under their own brand through OhTry Mobile, OhTry government solutions, ohtry.ai applications, and custom enterprise applications we build and host.
Who is the sender. When a message is sent from a number provisioned to a Platform Customer, that Platform Customer is the message sender and the party responsible for the content and for the recipient's consent. OhTry acts as the connectivity and software provider.
Brand and campaign registration. OhTry registers each Platform Customer as its own 10DLC Brand and Campaign (or toll-free verification) with The Campaign Registry through our Twilio ISV account. Platform Customers must supply accurate legal entity information, EIN, website, opt-in evidence, sample messages, and use case details, and must not share, sublease, or resell their provisioned numbers or messaging capacity to any other party without OhTry's written approval. Number sharing across unrelated brands ("snowshoeing") is prohibited.
Subaccount isolation. Each Platform Customer's traffic, numbers, message logs, and opt-out lists are maintained in a dedicated subaccount and are not commingled with other customers. OhTry maintains per-brand STOP/HELP handling, so an opt-out applies to the sending brand the recipient interacted with.
Required disclosures for Platform Customers. Every Platform Customer must publish its own privacy policy and messaging terms containing opt-in language, message types and frequency, "Message and data rates may apply," STOP/HELP instructions, and a statement that no mobile information is shared with third parties or affiliates for marketing purposes. OhTry provides this page as a model and may require evidence of consent capture before enabling messaging.
Enforcement. OhTry monitors delivery, opt-out, and spam complaint rates and may throttle, suspend, or reclaim numbers and subaccounts for violations of these terms, our Acceptable Use Policy, Twilio's Messaging Policy, or CTIA guidelines.
10. Your Responsibilities
You must be the subscriber of, or have authority over, the mobile number you provide, and you must notify OhTry if that number is reassigned or no longer yours. Platform Customers who send their own messages are separately responsible for obtaining prior express (or prior express written, where applicable) consent from their recipients, honoring opt-outs promptly, maintaining consent records, and complying with the TCPA, CAN-SPAM, CTIA guidelines, carrier requirements, and 10DLC registration obligations.
